Edward Meller issues digital Gift Vouchers and Promotional Gift Vouchers. All Gift Vouchers are treated as cash and cannot be replaced if lost or stolen. Gift Vouchers may only be used for purchases at Edward Meller Stores and cannot be returned or exchanged for cash. Gift Vouchers cannot be on-sold to third parties, unless with the prior written consent of Edward Meller. Edward Meller Gift Vouchers in AUD currency cannot be redeemed outside of Australia. No change is given. Gift Vouchers expire 36 months after purchase unless otherwise stated. Any balance that remains on the Gift Voucher after expiry will not be available for use, except as required by law.
Edward Meller no longer issues Physical Gift Vouchers. Legacy Physical Gift Vouchers already in circulation remain valid until their expiry date and may be redeemed in accordance with these Terms and Conditions.

In the Terms and Conditions:
"Activate" means the initial loading of value onto an Edward Meller Gift Voucher.
"Credit Note" means a physical card in plastic form issued as store credit.
"Edward Meller" means Edward Meller Pty Ltd (ABN: 67-678-543-649) trading as ‘Edward Meller’, 9 Taunton Drive, Cheltenham VIC 3192.
"Edward Meller Store" means an Edward Meller boutique or an outlet store operated by Edward Meller in Australia but does not mean any concession stores operated by Edward Meller in department stores such as David Jones.
"Gift Voucher" means any stored-value voucher issued by Edward Meller, including:
"eGift Voucher" means a digital voucher emailed to the recipient. eGift Vouchers may be purchased online or in-store at an Edward Meller Store.
"Expiry Date" means three (3) years after the date on which the voucher is supplied to you by Edward Meller, unless otherwise stated. A Promotional Gift Voucher expires one (1) month after the date of issue or such other date as prescribed by the promotion. Credit Notes have a twelve (12) month expiry date after the date of issue.
"Head Office" means the principal place of operations of Edward Meller and can be contacted via email at webstore@edwardmeller.com.au.
"Promotional Gift Voucher" means a voucher issued as part of a promotion, campaign, or qualifying purchase. Promotional Gift Vouchers may be issued in digital format or physical printed card format. They are typically single-use and may have shorter validity.
"Physical Gift Voucher" means a legacy physical voucher/card in plastic form.
"Redeem" means to reduce the value loaded on your Gift Voucher by using the Gift Voucher to purchase goods or services from Edward Meller.
"Voucher Balance" means the unspent value of an Edward Meller Gift Voucher.
"Voucher Number" means the unique number/text printed on a Physical Gift Voucher or supplied digitally on an eGift Voucher.
"Website" means https://www.edwardmeller.com.au.
A reference to "we", "us", or "our" is a reference to Edward Meller.
A reference to "you" or "your" is a reference to the person who is taken to agree to these terms and conditions under clause 2.
2.1. These terms and conditions apply to all Gift Vouchers.
2.2. You agree to be bound by these terms and conditions by purchasing, activating, using, or attempting to use a Gift Voucher or by making a transaction enquiry or exercising any right to redeem value loaded on a Gift Voucher.
2.3. By purchasing, activating, using or attempting to use a Gift Voucher, or by making a transaction enquiry or exercising any right to redeem value loaded on a Gift Voucher, you warrant that you will comply with these terms and conditions and all applicable laws and that the Gift Voucher will not be used in any manner that is unlawful, misleading, deceptive, unfair or otherwise harmful to consumers.
2.4. If you are giving a Gift Card to another person, you should ensure that they are aware of the terms and conditions that apply to the Gift Voucher and the relevant expiry date of the Gift Voucher.
3.1. eGift Vouchers - eGift Vouchers are available to purchase online at edwardmeller.com.au or in-store at any Edward Meller boutique. eGift Vouchers are in variable denominations up to AUD$500. eGift Vouchers are typically received by the nominated recipient via email within one business day of order unless there are unforeseen delays. Payment must be cleared prior to dispatch. eGift Vouchers are delivered active. eGift Vouchers can be redeemed in-store by presenting them in their printed format or customers can present their mobile device with an image of the eGift Voucher showing the eGift Voucher number. eGift Voucher can be redeemed on the Website by entering the eGift Voucher number when prompted at the checkout.
3.2. Promotional Gift Vouchers - From time to time, Edward Meller may issue Promotional Gift Vouchers in conjunction with qualifying purchases or such other offer or promotion offered by Edward Meller. Promotional Gift Vouchers may have a shorter validity date and are single use only. One Promotional Gift Voucher per person per transaction and use excludes payment of an existing account payment and/or purchase of Gift Vouchers. Promotional Gift Vouchers can only be redeemed in the country of issue and cannot be reactivated when expired.
3.3. Legacy Physical Gift Vouchers - Edward Meller no longer issues Physical Gift Vouchers. Legacy Physical Gift Vouchers already in circulation remain valid until their expiry date and may be redeemed in accordance with these Terms and Conditions.
3.4. Gift Vouchers for Personal Use - Purchases of Gift Vouchers for personal use are capped at AUD$1,000. Orders for Gift Vouchers over AUD$1,000 in the store are to be directed to Head Office for processing, and final discretion on Gift Vouchers for personal use lies with Head Office.
3.5. Gift Vouchers are valid for use until the Expiry Date. Any Voucher Balance/unspent value cannot be used or redeemed after the date of expiry and will not be reimbursed in cash or kind. The expiry date can also be found on the proof of purchase in transactions in which the Gift Voucher is used.
3.6. GST is not applicable to the sale of Gift Vouchers.
3.7. We may change the maximum amount that can be loaded onto a Gift Voucher at any time and at our absolute discretion. Any changes to the maximum amount will be published on the Website.
eGift Vouchers:
Subject to clause 4.5, Gift Vouchers can be redeemed for goods and services in all Edward Meller Stores and online at edwardmeller.com.au. The redeemed value is deducted from the Voucher Balance. Any unspent value remaining on the Gift Voucher may be used for future purchases until the Voucher Balance is zero or the Expiry Date is reached. No change is given.
Legacy Physical Gift Vouchers without a printed barcode may be redeemed online. Legacy Physical Gift Vouchers with a printed barcode may only be redeemed in-store. Photographs of Physical Gift Vouchers are not accepted. Physical vouchers must be presented at the time of redemption. Gift Vouchers cannot be refunded, exchanged for cash, used to purchase other vouchers or reloaded. Resale is prohibited unless approved in writing. If the purchase exceeds the Voucher Balance, the difference must be paid using another payment method.
Promotional Gift Vouchers may be issued in digital or physical printed card format. They must be presented at the time of redemption. Promotional Gift Vouchers are single-use, may have shorter validity periods, and cannot be reactivated once expired.
Gift Vouchers cannot be redeemed over the phone. Gift Vouchers may not be used or redeemed in any concession stores operated by Edward Meller within department stores such as David Jones, nor for online purchases made through Edward Meller’s official partners (including The Iconic and David Jones). Gift Vouchers cannot be used to purchase other Gift Vouchers or store-value cards.
Gift Vouchers must be treated as cash. They cannot be replaced or refunded if lost or stolen. Once activated, Gift Vouchers may only be used for purchases at Edward Meller Stores and cannot be returned or exchanged for cash. Gift Vouchers are not reloadable.
The Voucher Balance can be verified on request or at the time of purchase in-store or via email. No change is given, and any remaining balance can only be used against future purchases at Edward Meller Stores. Any balance remaining after expiry will not be available for use.
Resale of Gift Vouchers is strictly prohibited unless prior written consent is obtained from Edward Meller. If approved, Gift Vouchers cannot be resold for more than their original purchase price.
Your use of a Gift Voucher at an Edward Meller Store is subject to all applicable store policies and any other terms and conditions relating to goods and services made available by Edward Meller.
Where the price of goods or services exceeds the Voucher Balance, you must pay the difference using another payment method accepted by Edward Meller.
Once a Gift Voucher has reached a nil balance, it cannot be reactivated or reloaded with value.
By redeeming a Gift Voucher, you agree not to engage in any conduct that is fraudulent or contrary to the intention of the Edward Meller Gift Voucher program, including but not limited to:
Whether a breach has occurred will be determined by Edward Meller at its sole discretion.
5.1. After a Gift Voucher has been activated, an additional value cannot be added to it.
6.1. Voucher Balance is printed on receipts and can be checked in-store, via email, or for eGift Vouchers by clicking “View gift card balance” in the original email. No change is given and any balance that remains on the voucher can only be used in whole or part against future purchases of Edward Meller.
7.1. You must treat your Gift Voucher like cash. They cannot be replaced or refunded if lost or stolen except where we have breached any condition or warranty implied under consumer protection legislation that cannot be excluded in these terms and conditions.
8.1. Nothing in these Terms and Conditions is intended to exclude, restrict or modify any statutory rights or remedies you may have under the Australian Consumer Law.
8.2. To the extent permitted by law and subject to clause 8.1 above, you acknowledge that you are responsible for your Gift Voucher, and are liable for all transactions made using your Gift Voucher; any conditions implied by any laws (other than the Australian Consumer Law) are excluded; we will not be liable to you for any loss or damage (whether direct, indirect, punitive, exemplary, incidental, special or consequential) howsoever caused arising out of or in any way related to your use of a Gift Voucher; we will not be in default under these Terms and Conditions due to a failure to exercise, or delay in exercising, a right or perform any of our obligations under these Terms and Conditions for any reason unless any such failure or delay is caused by our gross negligence; and if we are liable to you, we limit our maximum aggregate liability to the initial value loaded onto the Gift Voucher at the time of purchase. We will not be responsible for any lost or misdirected eGift vouchers, including where an incorrect email address has been provided to us. Anyone with access to the nominated email delivery address who received an eGift Voucher(s) will be presumed to be authorised to receive the eGift Voucher on your behalf. We do not accept liability for any unauthorized acceptance and any consequential unauthorised redemption of an eGift Voucher.
9.1. Edward Meller reserves the right to:
9.2. After a Gift Voucher is issued by Edward Meller, it may only be cancelled by you if the unspent value remaining on the Gift Voucher is zero or the Expiry Date has been reached.
9.3. The applicable penalty will be determined by Edward Meller in its sole discretion.
10.1. Gift Vouchers must not be used in connection with any marketing, advertising or other promotional activities (including without limitation in websites, internet advertisements, email, telemarketing, direct mail, newspaper and magazine advertisements, and radio and television broadcasts) unless you obtain our prior written approval from Edward Meller.
10.2. Use of our name or brands, or any names and logos of Edward Meller (other than in connection with the purchase or use of Gift Vouchers), and the use of any imagery provided by Edward Meller is strictly prohibited without the prior consent of Edward Meller.

11.1. Any personal information provided by you in connected with a Gift Voucher will be handled in accordance with our Privacy Notice, a copy of which can be accessed at https://www.edwardmeller.com.au/policies/privacy-policy.

12.1. These Terms and Conditions embody the entire agreement between you and Edward Meller in respect of your Gift Voucher. These Terms and Conditions are governed by the laws of Victoria, Australia.
